MYCOMM GENERAL TERMS AND CONDITIONS OF SALE

In accordance with Articles L211-8 and L211-18 of the French Tourism Code, the provisions of Articles R211-5 to R211-13 of the Tourism Code, reproduced below, do not apply to the booking or sale of transport tickets that do not form part of a package tour.

The brochure, quote, proposal, or program provided by the organizer constitutes the prior information referred to in Article R211-7 of the Tourism Code. Therefore, unless otherwise stated on the front of this document, the characteristics, special conditions, and prices of the trip as indicated in the brochure, quote, or proposal from the organizer shall become contractual upon signing the registration form.

If no brochure, quote, program, or proposal is available, this document constitutes the prior information referred to in Article R211-7 of the Tourism Code before being signed by the buyer. It shall become void if not signed within 24 hours of issuance.

In the event of contract transfer, the transferor and/or the transferee must first settle any resulting fees.

MYCOMM has taken out a professional liability insurance policy with HISCOX to cover its professional liability.


EXCERPT FROM THE FRENCH TOURISM CODE

Article R211-5

Subject to the exclusions provided for in the second paragraph (a and b) of Article L.211-8, any offer and sale of travel or holiday services must result in the issuance of appropriate documents that comply with the rules set forth in this section.

For the sale of airline or regular line transport tickets without any additional services, the seller must issue the buyer one or more travel tickets for the entire journey, either issued by the carrier or under its responsibility.

For transport on demand, the name and address of the carrier on whose behalf the tickets are issued must be mentioned.

The separate billing of different elements within the same package does not exempt the seller from the obligations under this section.

Article R211-6

Before concluding the contract, the seller must provide the consumer with a written document including the company’s name, address, and proof of its administrative authorization to operate. This document must include details on prices, dates, and key aspects of the services provided during the trip or stay, including:

  • Destination, transportation details (means, characteristics, and category used).
  • Accommodation details (location, comfort level, main characteristics, classification according to the regulations or customs of the host country).
  • Included meals.
  • Itinerary for circuit-based trips.
  • Administrative and health formalities (including border-crossing requirements and processing times).
  • Visits, excursions, and other included services (or those available at an additional cost).
  • Minimum or maximum group size required for the trip, and the latest date on which the consumer will be informed of any cancellation due to insufficient numbers (no later than 21 days before departure).
  • Deposit amount or percentage required at contract signing, along with the remaining balance payment schedule.
  • Price adjustment terms as stipulated in Article R.211-10.
  • Contractual and legal cancellation conditions (Articles R.211-11, R.211-12, and R.211-13).
  • Details on insurance coverage, including professional liability insurance for travel agencies.
  • Optional insurance for trip cancellation and assistance (including repatriation in case of accident or illness).
  • If the contract includes air transport, flight segment details as required by Articles R.211-15 to R.211-18.

MYCOMM SPECIFIC TERMS AND CONDITIONS OF SALE

PRICES

For your information, all our programs indicate what is included and what is not.

Generally, the following are not included in our prices unless explicitly stated: airport taxes, vaccination and visa fees, beverages, museum and monument entrance fees, stadium tickets. Prices cover travel-related services chosen by the client based on our brochures, technical sheets, or quotes.

MYCOMM reserves the right to adjust prices (upward or downward) in the event of significant changes, such as:

  • Airport and security taxes.
  • Exchange rate fluctuations.
  • Transportation costs, especially fuel prices.

Once a booking is confirmed, price modifications cannot occur within 30 days before departure, in compliance with legal regulations.

Airlines may adjust flight capacities, leading to potential cancellations, rescheduling, or delays of up to 24 hours, with a two-day notice, without bearing any associated costs.


BOOKING AND PAYMENT

Booking is confirmed upon contract signature (or online purchase) and requires a deposit or full payment of the trip cost.

  • A 50% deposit per person is required at booking.
  • If booking less than 7 weeks before departure, full payment is required.
  • The remaining balance must be settled at least 7 weeks before departure (without a reminder from MYCOMM).

Failure to make the payment within the deadline will result in cancellation. Payments must be made via bank check or postal order payable to MYCOMM.


MODIFICATION OR CANCELLATION

Any cancellation, regardless of timing, does not exempt the traveler from full payment. Modifications or cancellations must be sent via registered mail to the agency where the booking was made.

  • Up to 45 days before departure: 50% of the total trip price retained.
  • Less than 45 days before departure: 100% of the total trip price retained.
  • No-show at departure: 100% of the total trip price retained.
  • Name change: €15 minimum modification fee.

If MYCOMM cancels a trip due to insufficient participants, clients will be informed at least 21 days before departure and offered alternative solutions at the current price or a full refund.


MYCOMM LIABILITY

MYCOMM acts as a travel organizer and works with various service providers (transport, hotels, etc.).

Flight schedules are subject to operational changes, and MYCOMM is not responsible for delays, route changes, or airport substitutions due to external factors (e.g., strikes, weather, technical issues). Travelers should allow at least 3 hours for flight connections.

In case of force majeure (e.g., political unrest, requisition, official travel restrictions, strikes, severe weather, traffic congestion), MYCOMM may modify or cancel services without refund.

Important:

  • Passengers must comply with all passport, visa, and vaccination requirements.
  • Failure to present required documents (passport, visa, tickets, vaccinations) does not entitle a refund.
  • Complaints must be submitted within one month of return with supporting documents.

GENERAL REMARKS

  • Unused services or shortened trips are non-refundable.
  • Night-based pricing applies to stays and tours (arrival/departure timing may reduce total hours without refund).
  • A triple room is typically a double room with an extra bed.
  • Missed flights (charters or specials) are non-refundable.

ON-SITE REPRESENTATIVE

MYCOMM assigns a coordinator as the local liaison to ensure the smooth execution of services, help with airport formalities, and assist clients as needed.
